Minutes:

Councillor Parker proposed and Councillor Sayers-Cooper seconded that Councillor Ballard be appointed as Chair for this meeting.

 

Resolved: That Councillor Ballard be elected Chair of the Sub-Committee for the duration of the meeting.

Before the hearing started the applicant/representative and the representors were given the opportunity to have a discussion to see if an agreement could be reached between them and the hearing was delayed for a short time.

 

Those attending were introduced, and the Chair of the Licensing Sub-Committee welcomed all parties to the hearing and detailed the procedure for the hearing.

 

The Specialist Advisor for Licensing, Jade Marshall, presented the report to the Sub-Committee and summarised the details. 

 

The Applicant’s representative, Mr Simon Gordon, addressed the Sub-Committee and responded to questions on behalf of the applicant, Ionela Pricop. The Licensing Sub Committee were informed that following discussions with the representors that the applicant, at the hearing, was no longer asking for recorded music to be licensed after 23:00hrs.

 

The Representors, Susan Littleford and Eugenija Sidabriene, addressed the Sub-Committee and responded to questions.

Following all the evidence presented, the Sub-Committee retired to consider and determine the application.  Michele Wilkinson, Housing and Regulatory Lawyer was in attendance to assist with any legal queries.  The Sub-Committee provided the following decision:

 

Resolved: The Sub Committee resolved to vary the premises licence on the basis of the agreement between the parties, with the removal of recorded music to be licensed after 23:00hrs, and to add two conditions to the premises licence:

 

  • The premises licence holder shall supply a mobile phone and landline number to the local residents in Ivy Terrace, so that any concerns could be communicated; and
  • The outdoor part of the premises shall not be used after 21:00hrs.

 

The original additional conditions, as outlined on page 24 of the Report, were removed.

 

For the sake of complete clarity, the following conditions will be retained:

 

  • Doors may be opened for normal entrance and egress of people but must be shut immediately thereafter;
  • Customers will not be permitted to take alcohol outside the premises to consume whilst smoking, congregating, or eating on the pavement outside the premises; and
  • The volume of amplified sound used in connection with the entertainment provided shall at all times be under the control of the Licensee/Management and the controlling mechanism shall be operated from a part of the Premises not accessible to the public.  

 

Reasons for the decision

 

The Licensing Sub Committee took into account the agreement made between the parties and were content, on the basis of that agreement, that the variation to the licence would not undermine the licensing objective of public nuisance.

 

The Licensing Sub Committee also took into account that no Responsible Authority had made a representation.
