Appointment of Chair

Minutes:

Councillor Rodohan proposed and Councillor Vaughan seconded that Councillor Diplock be appointed as Chair for this meeting.

 

RESOLVED:  That Councillor Diplock was appointed Chair for the meeting.

Apologies for absence / declaration of substitute members

There were none.

Declarations of Disclosable Pecuniary Interests (DPIs) by members as required under Section 31 of the Localism Act and other interests as required by the Code of Conduct

Exclusion of Public

It is considered that discussion of the following item is likely to disclose exempt information defined in paragraphs 1 and 2 of Schedule 12A of the Local Government Act 1972 and may therefore need to take place in exempt session. Furthermore, in relation to paragraph 10 of Schedule 12A, it is considered that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

RESOLVED: That the public be excluded from the remainder of the meeting

as otherwise there was a likelihood of disclosure to them of exempt

information as defined in schedule 12A of the Local Government Act 1972.

Determination of ‘fit & proper’ status of driver in relation to his Dual Drivers Licence

The Sub-Committee considered the Officer’s report, the representations

made and whether the applicant was a ‘fit and proper’ person to continue to hold a Dual Drivers Licence.

 

RESOLVED - To suspend the driver’s dual drivers licence for a period of four weeks. This decision does not have immediate effect.

 

Reasons - The Sub-Committee took into account the seriousness of the complaint made against the licence holder and the potential impact upon public safety. The Sub-Committee was concerned by the licence holder’s lack of awareness of licensing rules and the inconsistencies in his account of the events. However, the Sub-Committee was satisfied that a suspension, rather than the revocation of his licence, would be an appropriate sanction in all the circumstances.

 

 

 

 

6.

Determination of 'fit & proper' status of driver in relation to his Dual Drivers Licence

The Sub-Committee considered the Officer’s report, the representations

made and whether the applicant was a ‘fit and proper’ person to continue to hold a Dual Drivers Licence.

 

RESOLVED – To revoke the driver’s dual drivers licence, but not with immediate effect.

 

Reasons - The Sub-Committee was satisfied that the licence holder had deliberately attempted to mislead it in his account of the relevant events. The Sub-Committee considered this to be serious matter and that his actions made the licence holder not a ‘fit and proper’ person to hold a dual driver’s licence.
