Minutes:

Councillor Belsey proposed and Councillor di Cara seconded that Councillor Ballard be appointed as Chair for this meeting.

 

Resolved: That Councillor Ballard be elected Chair of the Sub-Committee for the duration of the meeting.

Those attending were introduced, and the Chair of the Licensing Sub-Committee welcomed all parties to the hearing and detailed the procedure for the hearing.

 

The Specialist Advisor for Licensing, Dean Love, presented the report and supplementary information to the Sub-Committee and summarised the details. 

 

The Applicant addressed the Sub-Committee, supported by a friend, and responded to questions.

 

The Representor addressed the Sub-Committee, supported by her husband, and responded to questions.

Following all the evidence presented, the Sub-Committee retired to consider and determine the application.  Michele Wilkinson, Housing and Regulatory Lawyer was in attendance to assist with any legal queries.  The Sub-Committee provided the following decision:

 

Resolved: The Sub Committee resolved to grant the premises licence application with modified conditions.

 

Those modified conditions are those agreed between the applicant and the Police as set out in Appendix E of the Report, with a minor change to the first two conditions under heading Outside Areas (page 43) so as to define the outside area as being the area directly in front of the premises (the pavement) up to the kerb. In addition, on page 43 of the Report under heading Deliveries and Online would delete (a) and replace with “The premises licence holder shall ensure that all deliveries of goods and waste collections shall be carried out during the hours of 8.00hrs to 21.30hrs in such a manner as to prevent nuisance and disturbance to nearby residents”.

 

In addition, the Sub Committee added the conditions “The doors will remain closed, at all times, when music is played on the premises except for the entry and egress of customers” and “The premises licence holders phone number and email address shall be made available to all local residents on request”.

 

Reasons for the decision

 

The Sub Committee appreciated the concerns of the representors but, on balance, did not consider that the granting of the premises licence would undermine the four licensing objectives. Therefore, the Sub Committee were content to grant the premises licence, in light of the comprehensive conditions upon the licence.

 

The Members took into account that the premises were small and would largely be food led so any concerns about it becoming a nightclub were unfounded. In making its decision the Sub Committee also noted that the closing times were not late.

 

The Members were confident that the applicant would take all reasonable steps should any issues arise and considered that the premises would be responsibly managed. It was also noted that should there be any issues in the future at the premises that any Responsible Authority or any person could apply for a review of the licence which may address some of the representors concerns. 

 

The Sub Committee also noted that no Responsible Authority had made a representation.
