Purpose:

Off-Street Car parking enforcement in Eastbourne currently falls under criminal law, however the Government made the decision that car parking enforcement should be decriminalised and dealt with under Civil Law in 2004. The delegation for civil enforcement sits with ESCC and EBC will need to request ESCC support and approval to apply to the Department of Transport for car parking enforcement to be de-criminalised.

 

Agreement is therefore sought to enter negotiations with ESCC to seek their agreement for the application to the Department of Transport to decriminalise parking enforcement for EBC off street car parks and to deal with them under civil law going forward.

To authorise officers to explore the options for a move to civil enforcement of off-street parking regulations, and to delegate authority to the Deputy Chief Executive, in consultation with the Cabinet member for tourism, leisure, accessibility and community safety, and the Cabinet member for enterprise, community spaces and heritage assets, to take all necessary actions to implement the enforcement change.
