Determination of a Driver’s ‘fit and proper’ status to hold a Dual Driver's Licence

Decision Maker: Director of Service Delivery

Decision status: Recommendations Approved

Is Key decision?: No

Is subject to call in?: No

Purpose:

To determine a Driver’s ‘fit and proper’ status to hold an Eastbourne Borough Council Dual Private Hire and Hackney Carriage Driver’s Licence under the Local Government (Miscellaneous Provisions) Act 1976.

Decision:

To issue a written warning to the Driver, and that the warning to be kept on his record for a period of 12 months.

The written warning should advise that should there be any further points added to his driver’s licence within the 12 month period that his dual drivers’ licence would be reviewed by the Licensing Sub-Committee.

The written warning should also include a reminder that the Driver should report all convictions to the Licensing Authority within 7 days.

Reasons for the decision:

Specific delegation has been given to the Director of Service Delivery by the Chief Executive to undertake decisions in consultation with the Chair of the Licensing Committee (or Deputy Chair) in relation to licensing matters which would normally have been considered by a Licensing Sub-Committee.

This delegation is in place for the period in which meetings cannot be held in accordance with Government and Public Health England guidance to reduce the spread of the Covid-19.
